1. The website is hosted by Touchtecgl LTD (NZ), trading as Touchtec POS, and acts as an intermediary between the customer and the hospitality venue Bamboo Kitchen. These Terms and Conditions (“Terms”) govern the use of the website, delivery, pickup, dine-in orders, and the relationship between Touchtec POS, the hospitality venue Bamboo Kitchen, and the customer. You agree to be bound by these Terms by accessing or using the website. You may not use the website if you disagree with these Terms.
   
   

2. Ordering and Payment: Orders can be placed through the website or QR code at the table and must be paid for in full when ordering. Payments can be made with a credit or debit card or other payment methods as specified on the website. Orders will only be processed once payment has occurred. Touchtec POS acts only as a facilitator of the payment and does not take responsibility for the quality of the food ordered.
   
   

3. Delivery: Orders are delivered to specified delivery zones set by the venue Bamboo Kitchen. Delivery times are estimates only and may vary due to traffic or other circumstances. Delivery fees may apply and will be specified on the website when ordering. Touchtec POS will use reasonable endeavours to facilitate the delivery of orders on time but does not guarantee delivery times and will not be liable for any delay or failure to deliver or for food that is not in a consumable condition.
   
   

4. Pickup: Orders from Bamboo Kitchen can be picked up during their specified store hours, displayed on the website when ordering.
   
   

5. Dine-in: Customers can also order food while dining in at participating hospitality venues using QR codes. Payment must be made in full at the time of ordering.
   
   

6. Refunds and Cancellations: Orders may be cancelled or modified up to 20 minutes before the scheduled delivery, pickup, or dine-in time. The Bamboo Kitchen refund policy, available on the venue's Bamboo Kitchen website, will process refunds for cancelled orders. Touchtec POS acts only as a facilitator for the transaction, and Refunds and Cancellations are between the Customer and Bamboo Kitchen.
   
   

7. Food Quality: Bamboo Kitchen, the hospitality venue, is responsible for the quality and temperature of the food delivered, collected, or served. Touchtec POS takes no responsibility for the quality of the food. Any complaints or issues regarding food quality should be directed to Bamboo Kitchen.
   
   

8. Website Content: All content on the website, including menu items and pricing, is subject to change without notice. Touchtec POS makes no representation or warranty as to the accuracy, completeness, or reliability of any content on the website.
   
   

9. Liability: Touchtec POS will not be liable for any loss or damage arising from the use of the website or the ordering, delivery, pickup, or dine-in of food, except to the extent that such liability cannot be excluded by law.
